Heard learned counsel appearing for the applicants and the learned APP for the respondent-State.

The applicants are apprehending arrest in connection with FIR No.0065 of 2022 dated 24.02.2022 registered at Police Station Arnala, District Mira-Bhayandar, Vasai-Virar Police, for offences under Sections 420, 323 and 506 of the Indian Penal Code, 1860 (IPC). 3.
On the last date of listing, this Court had put a query to the learned APP as to whether custody of the applicant is required, considering the fact that the FIR was registered as far back as on 24.02.2022, for alleged offences that were committed between 12.08.2015 and 19.11.2018 and particularly Digitally signed by PRIYA KAMBLI Date:
2024.07.02 15:29:38 +0530 PRIYA KAMBLI in the backdrop of the fact that the anticipatory bail application of the applicants was also rejected way back on 09.05.2022. 4.
Today, the learned APP, on instructions, fairly states that considering the role of the applicants pertaining to offence under Section 323 of the Indian Penal Code, 1860, a direction to the applicants to attend the police station and to remain present before the investigating Officer would suffice, 1/2
908_ABA_1709_24.doc with a further direction to the applicants to co-operate with the investigation.

In view of the above, the application is allowed in the following terms: (i) In the event the applicants are arrested in connection with FIR No.0065 of 2022 dated 24.02.2022 registered at Police Station Arnala, District Mira-Bhayandar, Vasai-Virar Police, they shall be released on bail on furnishing PR Bonds of 25,000/- each (Rupees Twenty-five Thousand ₹ only) and one or two sureties in the like amount to the satisfaction of the trial Court;
(ii) the applicants shall remain present before the Investigating Officer on 04.07.2024 and 05.07.2024 between 10:00 a.m. and 12:00 noon and thereafter, as and when the Investigating Officer call upon them to remain present;
(iii) the applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case;
(iv) the applicants shall co-operate with the investigation and also in the proceedings before the trial court.

In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled. 7.
Needless to say, the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
