Heard learned counsel for the applicant and learned APP for respondent-State.

The applicant is apprehending arrest in connection with FIR No. 1510 of 2023 dated 5th October 2023 registered at Hadapsar Police Station, Pune, for offences under Sections 406 and 420 of the Indian Penal Code, 1860 (IPC).

Having perused the statement of the informant which led to registration of the FIR and the specific stand taken by the applicant, this Court finds that a case is made out for grant of interim relief for the following reasons :
(i) Even according to the informant, the last payment was made on 19th December 2020 in favour of a company called
Windsor Antique House Company and yet the FIR was filed almost after three years i.e. on 5th October 2023. (ii) The applicant specifically contends that he has nothing to do with the said Windsor Antique House Company and that the informant is falsely implicating the applicant in the backdrop of a dispute between the applicant and the informant in respect of events specifically stated in paragraphs 4 to 8 of the application.
(iii) The applicant specifically states that some time in April 2023, he had received a phone call from in-charge of Kharadi Chowkie of Chandan Nagar Police Station, Pune, in respect of the grievance being raised by the informant and that he had responded to the said phone call and appeared before the concerned in-charge Police Officer. He gave his explanation and thereafter, no action was taken. It is further stated that subsequently, on 14th July 2023, a notice was received from Assistant Police Inspector of Hadapsar Police Station, in respect of which also the applicant had responded and he had given answers to specific questions. But, the FIR was eventually registered three months thereafter i.e. on 5th October 2023.

The applicant undertakes to cooperate with the investigation and for the reasons recorded herein above, the following interim order is passed :
(a) Till the next date, in the event the applicant is arrested in connection with FIR No. 1510 of 2023 dated 5th October 2023 registered at Hadapsar Police Station, Pune, he shall be released on bail on furnishing PR Bond of Rs.50,000/- and one surety in the like amount to the satisfaction of the trial Court.
(b) The applicant shall remain present before the Investigating Officer on 12th and 15th July 2024 between 10:00 a.m. and 12:00 noon and thereafter, as and when called by the Investigating Officer. The applicant shall cooperate with the Investigating Officer and shall provide documents demanded by the Investigating Officer, during the course of investigation.
(c) The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.

In the event, the applicant violates any of the aforesaid conditions, the order passed today would be recalled. 6.
List the application for further consideration on 6th August 2024 (High on Board).
