On 10.07.2024, this Court granted interim relief in favour of the applicant, by recording specific reasons in paragraph No.3. One of the conditions imposed upon the applicant was that he would remain present before the investigating officer on 12.07.2024 and 15.07.2024 and thereafter, as and when called by the investigating officer. 2.
Today, when the application is called out for hearing, this Court is informed that the applicant did remain present before the investigating officer on the specified dates.

The learned APP submitted, on instructions, that thereafter, when the applicant was called, he did not remain present. It is claimed that the applicant was called on his mobile number to remain present, when he said that he was in Kolkata and he would be available in the week thereafter. In this backdrop, the learned counsel for the applicant submitted that if the investigating officer requires his further presence, the applicant shall remain present before the investigating officer. 5.
In view of the above, the applicant is directed to further remain present before the investigating officer on 11.10.2024 and 12.10.2024 and thereafter, as and when called by the investigating officer. 6.
List for further consideration on 12.11.2024, High on Board. 7.
