Heard learned counsel for the applicant and the learned APP for respondent-State.

The applicant apprehends arrest in connection with FIR No.0140 of 2024 dated 12.06.2024 registered at Police Station Rahimatpur, District Satara, for offences under Sections 406, 420, 504 and 506 read with Section 34 of the Indian Penal Code, 1860. The applicant is one of the two accused persons. The other accused person is the son of the applicant. 3.

The allegation against the accused persons is that although initially, they made full payment for having purchased soyabean from the informant, on subsequent occasion, they made only part payments and later on, the cheques issued were dishonoured.

Although the learned APP opposed relief in the present application and he seeks time to take instructions, this Court is inclined to grant interim 1/2

901_ABA_1812_24.doc relief to the applicant for the following reasons: (a) The applicant is a senior citizen aged about 60 years; (b) initially, full payment was made for supply of soyabean. Subsequently, part payment was made and thereafter, balance amount could not be paid;

(c) the cheques issued for the balance amount, which were dishonoured, were issued by the co-accused person and not the applicant. 5.

In view of the above, there shall be interim relief in the following terms:

(a) Till the next date, in the event the applicant is arrested in connection with FIR No.0140 of 2024 dated 12.06.2024 registered at Police Station Rahimatpur, District Satara, he shall be released on bail on furnishing PR Bond of Rs.25,000/- (Rupees Twenty-five Thousand only) and one or two sureties in the like amount to the satisfaction of the trial court; (b) the applicant shall appear before the investigating officer on 19.07.2024 between 10:00 a.m. and 12:00 noon and thereafter as and when required by the investigating officer;

(c) the applicant shall not influence the informant, witness or any person concerned with the case and he shall not tamper with the evidence. 6.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.
