Heard Mr. Powar, learned counsel for the applicant and Mr.Holambe-Patil, learned APP for the respondent-State. 2.

On 16.07.2024, this Court, while granting interim relief, observed as follows:- "4.

Although the learned APP opposed relief in the present application and he seeks time to take instructions, this Court is inclined to grant interim relief to the applicant for the following reasons:

(a) The applicant is a senior citizen aged about 60 years; (b) initially, full payment was made for supply of soyabean. Subsequently, part payment was made and thereafter, balance amount could not be paid;

(c) the cheques issued for the balance amount, which were dishonoured, were issued by the co-accused person and not the applicant."

There is nothing to show that the applicant has not co-operated with the investigation. As noted in the above-quoted portion, the MINAL SANDIP PARAB MINAL SANDIP PARAB Date: 2024.10.07 18:15:32 +0530 applicant is a senior citizen, aged about 60 years. Considering the 1/2

38_ABA1812_24.doc aforesaid fact and the reasons recorded in the above-quoted portion of the order dated 16.07.2024, this Court is inclined to allow the application.

Accordingly, the interim order dated 16.07.2024 is confirmed and the application is allowed, subject to the applicant continuing to cooperate with the investigation. The applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses or any other person concerned with the case. 5.

The application stands disposed of.
