Heard learned Advocate for Applicant and learned APP. It is true that Anticipatory Bail Application of this Applicant was rejected on 29th May 2023. On the basis of submissions liberty was granted to Applicant to deposit amount before the Sessions Court. Though he has not deposited, he has paid directly to the investors. Copies of five parties are annexed. Learned Additional Sessions Judge has taken hyper technical view in rejection Application on 15th April 2024. It is Kishor 1/2

10 ABA 1849 of 2024.doc observed in paragraph No. 11. Learned Additional Session Judge ought to have verified from the Police whether the investors are repaid or not. Let investigating agency may verify this fact from the investors. In view of that following order is passed :-

O R D E R

(a) In case of arrest the Applicant Bhimgonda Kumgonda Patil be released in connection with C. R. No. 24 of 2023 registered with Bhilawadi Police Station on furnishing P. B. and S. B. of Rs.25,000/-.

(b) He is directed to give attendance to the Police Station, Bhilawadi District Sangli on 2nd September 2024, 9th September 2024 and 16th September 2024.

Mater be kept on 20th September 2024.

The right of investigating agency to point out other materials is kept intact.
