This is an Application for anticipatory bail. 2.

The Applicant is apprehending her arrest in Crime No.159 of 2024 registered at Goregaon Police Station for the offences punishable under Sections 406, 420 read with 34 of the Indian Penal Code and Section 3 of the Maharashtra Depositors (Protection of Interests in Financial Institution Act), 1999.

The allegations against the present Applicant and the other coaccused are of defrauding the investors to the tune of Rs.50,00,000/-.

I have heard Learned Counsel for the Applicant, Learned APP for Respondent No.1-State and Learned Counsel for Respondent No.2-first informant.

Learned Counsel for the Applicant submits that pursuant to the orders passed by this Court, the Applicant has already deposited the amount of Rs.50,00,000/- in this Court.

Learned APP for Respondent No.1-State, on instructions, submits that the investigation is almost over.

Learned Counsel for Respondent No.2-first informant submits that the first informant be permitted to withdraw the said amount of Rs.50,00,000/-.

Considering the fact that the Applicant has deposited the entire amount of Rs.50,00,000/- allegedly defrauded by him, I am inclined to release him on anticipatory bail. Hence, the following order:

ORDER

i.

The Anticipatory Bail Application is allowed. ii.

In the event of the arrest of the Applicant in Crime No.159 of 2024 registered at Goregaon Police Station for the offences punishable under Sections 406, 420 read with 34 of the Indian Penal Code and Section 3 of the Maharashtra Depositors (Protection of Interests in Financial Institution Act), 1999, she shall be released on bail on furnishing a PR Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.

After filing of the chargesheet, Respondent No.2-first informant is permitted to file an application before the trial court for withdrawal of the amount of Rs. 50,00,000/- deposited by the Applicant. If such application is made, the trial court shall decide the same on its own merits. iv.

The Registry of this Court shall transfer the amount of Rs.50,00,000/- deposited by the Applicant in this Court along with accrued interest, if any, to the trial court. v.

Liberty is granted to the Applicant to file an application before the trial court for return of passport. If such application is made, the trial court shall decide the same on its own merits. 9.

The Anticipatory Bail Application is disposed of in the aforesaid terms.

The Interim Application stands disposed of.
