By order dated 18.07.2024, this Court granted interim order in favour of the applicant, specifically on the ground that the applicant was not named in the FIR, and therefore, no overt act could be attributable to him. In the order of the Sessions Court it was recorded that even under the statement recorded under Section 164 of the Code of Criminal Procedure, nothing had come on record against the applicant.

In terms of the direction issued while granting interim relief to the applicant, learned APP reports that the applicant has indeed cooperated with the investigation and he has appeared before the Investigating Officer. 3.

In that view of the matter, this Court is inclined to allow the present application.

Hence, the interim order dated 18.07.2024, is confirmed and the application is allowed. The applicant shall continue to cooperate with the investigation and he shall not influence the informant, witness or any persons concerned with the case.
