Sangeeta Prakash Kamble v. State Of Maharashtra
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.1904 OF 2024 Sangeeta Prakash Kamble ...
Applicant Vs.
State of Maharashtra ...
Respondent Mr. Praful Abhiman Patil i/b. Meraki Legal for Applicant. Mr. Kiran C. Shinde, APP for Respondent-State. Mr. R. B. Jadhav, Police Sub-Inspector, Chinchwad Police Station. CORAM : MANISH PITALE, J.
DATE : JULY 22, 2024 P.C. :
.
Heard Mr. Patil, learned counsel for the applicant and Mr. Shinde, learned APP for the respondent-State.
2.
The applicant herein is one of the persons apprehending arrest in connection with FIR No.0059 of 24.02.2024 registered with Chinchwad Police Station, District - Pimpri Chinchwad, for offences under Sections 323, 352, 498-A, 504 read with Section 34 of the Indian Penal Code, 1860 (IPC).
3.
The informant, in the present case, is the daughter-in-law of the applicant and the other accused persons are the husband and sister-inlaw of the informant. 4.
The Sessions Court rejected the anticipatory bail application of the applicant by an order dated 17.05.2024, observing that the application was premature. It is relevant to note that the applicant had filed the anticipatory bail application in the Sessions Court, before the by MINAL SANDIP PARAB Date:
2024.07.22 17:49:07 +0530 MINAL SANDIP PARAB FIR was registered. This was in the backdrop of the applicant having 1/3
been called to attend the Women's Cell of Pimpri Police Station for mediation on 11.02.2024. Subsequently, subject FIR dated 24.02.2024 was registered.
5.
At the outset, the learned counsel for the applicant points out that both the co-accused persons i.e. the husband and the sister-in-law of the informant were granted anticipatory bail by the Sessions Court itself on 12.06.2024.
6.
The allegations levelled by the informant in her statement, leading to registration of the FIR show that the thrust of her grievance is against her husband and that the name of the applicant is also taken at some places, alleging certain overt acts against her. 7.
But considering the fact that her husband i.e. the son of the applicant as well as her daughter have been granted anticipatory bail by the Sessions Court, on the ground of parity, the applicant certainly deserves relief. In any case, the applicant has undertaken to co-operate with the investigation. Therefore, the application is allowed in the following terms:- A.
In the event the applicant is arrested in connection with FIR No.0059 of 24.02.2024 registered with Chinchwad Police Station, District - Pimpri Chinchwad, she shall be released on bail on furnishing PR Bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount;
B.
The applicant shall co-operate with the investigation and she shall remain present before the investigating officer as and when called by the investigating officer, till filing of the charge-sheet;
C.
The applicant shall not influence the informant, witnesses or 2/3
any person concerned with the case and she shall not tamper with the evidence.
8.
In case any of the aforesaid conditions are violated, the present order would be liable to be cancelled.
9.
The application stands disposed of.
