Heard learned counsel for the applicant and learned APP for respondent-State.

In the present case, the applicant is apprehending arrest in connection with FIR No. 0181 of 2024 dated 22nd June 2024 registered at Supa Police Station, Pune, for offences under Sections 324, 323, 504, 506 and 507 read with 34 of the Indian Penal Code, 1860 (IPC) and Sections 4 and 25 of the Arms Act, 1959. 3.
In this case, there are four accused persons, including the applicant.

With the assistance of the learned counsel for the applicant and the learned APP, this Court has perused the statement of the informant, leading to registration of the FIR.

Although, the informant has made specific allegations against the accused Ashish Jadhav and Rushi Jamale about assault and consequent injuries suffered by the informant, as against the applicant there is only one allegation. The said allegation pertains to the applicant having allegedly given a phone call to the informant on 22nd June 2024, when the applicant abused the informant. Apart from this, there is no other allegation made against the applicant and therefore, he has made out a prima facie case in his favour to the effect that ingredients of the offences may not be made out against him.

In view of the above, the application is allowed in the following terms :
(a) In the event the applicant is arrested in connection with FIR No. 0181 of 2024 dated 22nd June 2024 registered at Supa Police Station, Pune, he shall be released on bail on furnishing PR Bond of Rs.25,000/- and one or two sureties in the like amount to the satisfaction of the trial Court.
(b) The applicant shall remain present before the Investigating Officer on 26th July 2024 between 10:00 a.m. and 12:00 noon and thereafter, as and when called by the Investigating Officer. The applicant shall cooperate with the investigation.
(c) The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses or any other person concerned with the case.

Needless to say, violation of any of the aforesaid conditions would make the applicant liable to face proceedings for cancellation of anticipatory bail. It is also clarified that the observations made in this order are limited to the question of grant of anticipatory bail to the applicant in the present application.
