Heard learned counsel for the applicants and learned APP for the respondent-State.

By order dated 7th August 2024, this Court had granted interim order in favour of the applicants.

While granting interim order, this Court had observed as follows :

Considering the fact that the applicants have already suffered incarceration for some period of time on the basis of similar/identical allegations made in the earlier FIR and thereafter, they have been granted regular bail, as also the fact that the applicants undertake to cooperate with the investigation, this Court is inclined to grant interim relief to the applicants.

On instructions, the learned counsel for the applicants
bipin prithiani 12-aba-1974.24.doc has made a statement that the affidavits, as directed by this Court and the Sessions Court, while granting regular bail to the applicants in the earlier case, have been filed within the stipulated period before the MPID Court. The learned APP to verify the correctness of the said statement before the next date of listing."

The learned APP, on instructions, submits that affidavits as directed by this Court and the Sessions Court, while granting regular bail to the applicants in the earlier case, have been indeed filed and that the statement made before this Court on behalf of the applicants on 7th August 2024, is correct. The applicants indeed remained present before the Investigating Officer and they have cooperated with the investigation.

In view of the above, this Court is of the opinion that interim order dated 7th August 2024 deserves to be confirmed. 6.
Accordingly, the interim order is confirmed and the application is allowed.

The applicants are directed to continue to cooperate with the investigation. They shall not influence the informant, witnesses or any person concerned with the case and they shall not tamper with the evidence.

The application is disposed of.
