By order dated 26th July 2024, this Court had granted interim relief in favour of the applicants, subject to specific conditions, including a direction to the applicants to cooperate with the investigation.

The learned APP, on instructions, submits that the applicants have indeed cooperated with the investigation. 3.

This is a case where the FIR, on the face of it, has been registered after delay of about 3 and 1⁄2 months. It is a case of cross FIRs, wherein earlier FIR bearing No.1231 of 2023 dated 21st November 2023 was registered, wherein the informant in the BIPIN DHARMENDER PRITHIANI DHARMENDER PRITHIANI Date: 2024.11.12 19:21:28 +0530

bipin prithiani 4-aba-1978.24.doc present case was arraigned as an accused with two other accused persons. The fact that there are two versions to the same incident and the FIR against the applicants has been registered prima facie in a delayed manner, coupled with the fact that the applicants have indeed cooperated with the investigation after the interim order was passed in their favour, this Court is inclined to allow the application.

Accordingly, the interim order dated 26th July 2024 is confirmed and the application is allowed.

This Court is further informed that the charge-sheet is already prepared for submission before the Competent Court. In that light, it is directed that the applicants shall cooperate in further proceedings before the concerned Court. MANISH PITALE, J.
