Date: 24 October 2024.
P.C.:
Heard Mr Shyam Dewani, the learned Counsel appearing on behalf of applicant and Mr Amit Palkar the learned APP representing respondent/State.
2.
By this application, the applicant seeks pre-arrest bail in connection with CR No.0154 of 2024, registered at Manpada Police Station, Dombivali, Thane, for offences punishable under
Sections 420, 465, 467, 468, 120(B) read with 34, of the Indian Penal Code (IPC).
3.
At the outset, the learned Additional Public Prosecutor representing the respondent/ State, based on instructions from the investigating officer who is present in the Court, submits that the investigation has been completed, and the charge sheet has been duly filed. Furthermore, the prosecution no longer seeks the custody of the applicant.
4.
Upon perusing the records, it is evident that the investigation has concluded, and the charge sheet has been filed. The fact that the prosecution does not seek the custody of the applicant suggest that there is no objection to the granting of anticipatory bail. Additionally, the nature of the dispute appears to be of civil nature. At any rate, the offence centres around the documents and the investigation has progressed to the point where the charge sheet has already been filed, custodial interrogation of the applicant seems unwarrnated at this stage. In view of the above, the application stands allowed in following terms :
(i) In the event of arrest, the applicant shall be released on bail in CR No.0154 of 2024, registered with Manpada Police Station,
Thane, on executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.
(ii) The applicant, himself or through any other person, shall not tamper with the evidence or influence any witnesses.
5.
The application stands disposed of accordingly. [ R.N. Laddha, J. ]
