Heard Ms. Ankita Bamboli, the learned counsel for the applicant and Mr. Arfan Sait, the learned Additional Public Prosecutor representing the respondents / State.

This is an application for pre-arrest bail filed by the applicant, apprehending arrest in C.R. No.662 of 2024, registered with Narpoli Police Station, Thane, for the offences punishable under Sections 380, 454 and 411 of the Indian Penal Code.

The prosecution contends that co-accused unlawfully entered the informant's house, forcibly opened a cupboard, and stole cash along with gold ornaments valued Rs.1.40 Lakhs. Further, investigation releaved that the applicant, a goldsmith who runs a jewelry shop, received 25 gms of this stolen gold from the co-accused, Moinul Abdul Hanif Aslam. The learned APP, based on instructions from the investigating officer present in Court, acknowledges the applicant's cooperation and reports that the applicant has surrendered 25 gms of gold to the investigating agency and cooperated with the investigation. The coaccused who is alleged to have committed theft has already been released on bail and the prosecution intends to file a charge sheet against the applicant shortly. With the investigation now complete and nothing remains to be recovered from the applicant, the learned APP fairly concedes that the applicant's custodial interrogation is not necessary. In light of these circumstances, this Court is inclined to grant anticipatory bail to the applicant. Hence, the following order.
ORDER
(i) In the event of applicant's arrest in connection with C.R. No.662 of 2024, registered with Narpoli Police Station, Thane, he shall be released on bail on furnishing a PR Bond of Rs.25,000/- with one or more sureties in the like amount.
(ii) The applicant shall cooperate with the investigation and shall not indulge in activities that would tamper with the evidence or influence the witnesses.
