In the present matter the earlier application was withdrawn in view of the affidavit filed by the Commissioner of Police before the Division Bench in a connected matter, stating that Police does not want custody of the Applicant. However, subsequently on realizing that despite the said affidavit Police are trying to seek custody of the Applicant, this application came to be filed. 2.
This application has come up before this Court in view of the Notification dated 8th February 2024. However, after going through the said Notification dated 8th February 2024 it is apparent that said Notification is applicable to the cases where first application arising MANISH SURESHRAO THATTE Date: 2024.08.16 09:55:46 +0530 MANISH SURESHRAO THATTE from same FIR was decided by a particular Judge. However, in the present case, admittedly the application was withdrawn and it was not considered on merit by this Court.

In that view of the matter, place this matter before appropriate Bench having assignment of anticipatory bail applications. 4.
Considering that tomorrow there is a holiday and the matter will take some time to list before the appropriate Bench, and further considering that in the earlier application ad-interim anticipatory bail was granted to the Applicant and it was in operation for quite long time, it is directed to the Respondents not to arrest the Applicant for one week from today.
