After hearing the learned counsel for the applicant and the learned APP for some time, this Court put a specific query to the learned counsel for the applicant as to whether when the applicant and the co-accused persons claimed at the time of the incident that they were provisional possession holders of the land in question, any proceeding was pending before a Competent Civil Court in that context. The learned counsel for the applicant sought adjournment to take proper instructions in the matter. 2.

It would be necessary for this Court to know whether the genesis of the claim of the accused persons to the land has any roots in a civil dispute pending before a Competent Court.
