By 19.09.2024, this Court recorded that applicant No.1 was already arrested and hence, the prayer in the present application, as regards applicant No.1, was rendered infructuous.

As regards applicant Nos.2 and 3, interim order was granted with a specific direction that they would appear before the investigating officer on 23.09.2024 and 24.09.2024 and thereafter, as and when called by the investigating officer.

The learned APP submitted, on instructions, that the applicants did not abide by the said direction and they failed to appear before the investigating officer.

It is to be noted that by the very same order, this Court had issued notice to the first informant. The learned APP informs that the first Digitally signed by PRIYA KAMBLI Date:

910_ABA_2378_24.doc informant (respondent No.2) was served. There is no appearance on behalf of the said respondent.

The learned counsel for the applicants submitted that they had given a proposal to respondent No.2. But, there is no response till date. 6.

In any case, there is nothing to show that the applicants abided by the direction given by this Court for them to appear before the investigating officer. On this ground itself, the application deserves to be dismissed. 7.

But, at this stage, the learned counsel for the applicants made a fervent plea that one more chance may be given to the applicants. 8.

In that light, list this application for further consideration on 23.10.2024 at the top of the supplementary list. 9.

In the meanwhile, the applicants shall appear before the investigating officer on 21.10.2024.
