When this application is called out for hearing, the learned APP points out that this is the fourth anticipatory bail application filed by the applicant before this Court.

The first anticipatory bail application bearing Anticipatory Bail Application No.1132 of 2023 was dismissed on merits by this Court (Coram : N. R. Borkar, J.) by an order dated 21.04.2023. 3.
The second anticipatory bail application bearing Anticipatory Bail Application No.2851 of 2023 was disposed of as withdrawn by this Court (Coram : N. R. Borkar, J.) by an order dated 03.11.2023. 4.
The third application bearing Anticipatory Bail Application No.559 of 2024 was dismissed as withdrawn before this Court (Coram : MINAL SANDIP PARAB by MINAL SANDIP PARAB Date:
2024.09.13 14:53:39 +0530 N. R. Borkar, J.) on 02.03.2024.

In terms of the circular, this fourth application is listed today before the assigned Court as N. R. Borkar, J. is not available at the principal seat of this Court.

It is unfortunate that the applicant has filed application after application seeking anticipatory bail despite the fact that the first such application was dismissed on merits by this Court by an order dated 21.04.2023 and subsequently, two such anticipatory bail applications were dismissed as withdrawn.

It is to be noted that the Sessions Court had already dismissed anticipatory bail application of the applicant by a reasoned order on 05.04.2023. Filing of this fourth anticipatory bail application is clearly an abuse of the process of the Court and on this ground alone, the application is dismissed.
