CRIMINAL APPELLATE JURISDICTION CR. ANTICIPATORY BAIL APPLICATION NO. 2469 OF 2024 Nilesh Sunil Burade ...Applicant

Versus

State of Maharashtra and Anr.

...Respondents

__________ Mr. Ganesh Bhujbal, for the Applicant.

Ms. Kanchan Pawar i/b. Ms. Shilpa Pawar, (Appointed Legal Aid) for the Respondent No.2.

Ms. Supriya Kak, APP for the Respondent - State. __________ CORAM :

ADVAIT M. SETHNA, J.

DATE :

6 OCTOBER 2025 P.C.:

1.

Heard learned counsel for the parties.

2.

Ms. Kanchan Pawar, learned counsel holding for Ms. Shilpa Pawar who is appointed by this Court to represent the victim would request for some time as the arguing counsel Ms. Shilpa Pawar is in personal difficulty today and hence, is not present in Court. Ordinarily, the request for adjournment would not have been entertained as this bench is specially constituted for today. However, it appears that the proceedings involve allegations under the Protection of Children from Sexual Offences Act, 2012 (for short "POCSO Act") as well as the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short "Atrocities Act") which would in the interest of justice, entail hearing of the victim. In the given situation, although the Pallavi

21-ABA-2469-2024.doc Applicant is protected by order dated 13 September 2024 and the anticipatory bail application would warrant a hearing, it is for such reason that the Court is requested to adjourn the proceedings. However, it is made clear that the hearing of this Application shall be proceeded with on the adjourned date.

3.

In such situation, place this application on 13 October 2025. 4.

The protection granted to the Applicant by order dated 13 September 2024 shall continue till the next date. [ADVAIT M. SETHNA, J.] Pallavi
