The learned APP has handed over the Inquiry Report dated 22/4/2025 of the Chief Public Prosecutor, in a seal packet. 2.
I have gone through the said enquiry report. As far as the scope of the enquiry is concern, pertaining to the present proceeding, the issue still remains whether the documents which are part of list of documents tendered by the applicant at page nos.32 and 33, which bears reference and date written in blue pen and signature of police officer in original and also signature and rubber stamp of Senior Police Inspector, Borivali Railway Police Station, whether the same was obtained by the accused on a RTI application being preferred ?
Diksha Rane 1 ABA 2528-2024.doc The anticipatory bail application was already rejected by this Court by an order dated 6/3/2025. The matter today before me is only for "compliance". As far as the compliance is concerned, the said act has been done by the office of the learned APP.

If the Chief Public Prosecutor is of the opinion that the communication between the office of the Public Prosecutor, with the IO, is a privilege communication between an advocate and their clients, then the same should not be made available to the general public and more particularly to the accused. The intimation to that effect can be communicated to all the Police Stations/Departments in the State of Maharashtra.
