Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R.No.421 of 2023 registered with Matunga Police Station for the offences punishable under Sections 120-B, 406, 420, 468, 471 and 506(2) of the Indian Penal Code, 1860.

By an order dated 3 October 2024, this Court was persuaded to grant interim bail to the applicant observing, inter alia, as under : "5.

I have perused the allegations in the FIR. It appears that the applicant had allegedly introduced the first informant to another person, who was then identified as Mr. Chavan. The latter demanded a sum of Rs.47,00,000/- and first informant was allegedly induced to part with the said amount. The FIR, thereafter, does not make any reference to the applicant.

Prima facie, from the perusal of the allegations in SSP 1/3

the FIR, it becomes evident that there were multiple transactions between the first informant and the Ali Shaikh.

It appears that first informant had realized that there was something amiss with the initial transactions entered into with Ali Shaikh and, yet, there were further transactions between the Ali Shaikh and the first informant. The cheques drawn by the Ali Shaikh were also allegedly dishonoured."

Learned APP, on instructions, submits that the applicant has appeared before the Investigating Officer and co-operated with the investigation. 5.

In view of the aforesaid submission, having regard to the nature of the accusation, the material pressed into service against the applicant and the reasons which weighed with this Court in granting interim bail, I am inclined to make the order of interim bail absolute.

Hence, the following order :

ORDER

(i) The Application stands allowed.

(ii) The order dated 3 October 2024 granting interim bail to the Applicant is made absolute on the terms and conditions incorporated therein. (iii) The applicant shall henceforth appear before the Investigating Officer as and when directed.

(iv) The applicant shall regularly attend the proceedings before the SSP 2/3

jurisdictional Court.

(v) By way of abundant caution, it is clarified that the observations made hereinabove are confined for the purpose of determination of the entitlement for pre-arrest bail only.

Application disposed.
