By a separate order, today this Court dismissed the application. At the stage of pronouncement of the order, the learned Senior Counsel appearing for the applicant prayed for stay of the order for a period of 2 weeks, on the basis that from the date of the incident, considerable time has lapsed and an important question of law has been decided by this Court in the order passed today.

This Court is of the opinion that considering the reasons stated in the order pronounced today and in the light of the fact that the applicant could not be apprehended for a considerable period of time, no ground is made out for allowing the prayer

bipin prithiani 901-aba-2564.24.doc made on behalf of the applicant. In any case, this Court had not granted interim relief, during the pendency of this application. It is to be noted that when this Court closed the matter for orders, the learned Senior Counsel for the applicant as well as the Special Public Prosecutor sought time till 9th October 2024 for filing written notes along with copies of relevant judgments. In this backdrop, only a statement of the learned Special Public Prosecutor, on instructions of the officer present in Court, was recorded that coercive action would not be taken till the application was decided. Today, there is no such statement being made.
