DATE : 13th MARCH, 2025 P.C. :- This application is filed for pre-arrest bail under Section 482 of the Bharatiya Nagrik Suraksha Sanhita, 2023 in connection with FIR No. 0118/2024 dated 13th July, 2024 registered with Koregaon Park Police Station, Pune City for the offences punishable under Sections 316(2), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 5, 8, 9 of the Maharashtra Ownership of Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act,

The learned counsel for the parties jointly submit that the interim order granted in the present anticipatory bail application can be confirmed as the parties have settled their dispute. 3.

A quashing petition for the present anticipatory bail application has already been filed and is pending for hearing. 4.

Although this is not a forum for settlement of such disputes, but since the applicant did show bonafides to pay. 5.

In view of the joint statement made by the learned counsel and in view of the affidavit dated 11th February, 2025 filed by one Mr.Vishwajeet Subhash Jhavar which has been taken on record by me on 27th February 2025, the interim order granted earlier stands confirmed. The anticipatory bail application is allowed. Hence the following order :-

ORDER

(a) The anticipatory bail application is allowed.

3/4 (b) In the event of arrest in connection with FIR No. 0118/2024 dated 13th July, 2024 registered with Koregaon Park Police Station, Pune City for the offences punishable under Sections 316(2), 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 5, 8, 9 of the Maharashtra Ownership of Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- with two or more sureties of the like amount. (c) The applicant shall co-operate with the investigation and attend the Investigating Officer of the concerned Police Station, as and when called. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

4/4 (e) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the Investigating Officer.
