Heard, Mr. Kasliwal, learned counsel for the applicant and Mr. Sonavane, learned APP for the respondent - State. 2.

The applicant has approached this Court, apprehending arrest in connection with First Information Report No.0016 of 2024, dated 31.01.2024, registered at Police Station Ozar, District Nashik, for offence under Section 302 of the Indian Penal Code, 1860 (IPC). 3.

The informant in the present case is a police officer, who caused the FIR to be registered, when dead body of the victim was found in his house. It is found that the victim had suffered multiple injuries, due to which he expired. Investigation led to the four accused persons, against whom the FIR has been registered. The statement of one of the witnesses Dnyaneshwar Sangamnere, recorded during the course of investigation, describes in graphic detail as to the manner in which the victim was assaulted. Specific role is attributed to the applicant, as having assaulted the victim by means of a wooden plank. It is also specifically stated that the applicant alongwith co-accused persons continued the assault after the victim had entered his house after the initial assault.

The postmortem report shows multiple injuries to the victim, which ultimately resulted in his death. The investigation was completed and charge-sheet was filed under Section 299 of the Code of Criminal Procedure, 1908.

The material on record prima facie shows direct involvement of the applicant in the incident in question.

No case is made out for granting anticipatory bail. The application is dismissed.
