In this application on 15th October, 2024, this Court granted interim relief in favour of the applicant. It was observed that although the Sessions Court did take note of the settlement agreement between the applicant and the first informant, relief was not granted to the applicant on the ground that his active role was obvious in the present case. 2.

In that light, this Court granted leave to the applicant to add the first informant as respondent No.2 and notice was issued to the said respondent with a direction to the applicant to serve a copy on the Investigating Officer, who would in turn serve the respondent No.2. 3.

Today, the learned APP submits on instructions that respondent No.2 was served, but the office note shows that service is awaited. Shrikant Malani

Even if respondent No.2 has been served, today there is no appearance on his behalf.

In this backdrop, list this application for further consideration on 13th January, 2025, "High on Board."
