During the course of arguments, it is pointed out by Mr.Sonavane, learned APP that since the prayer for anticipatory bail of the applicant has been rejected by the Sessions Court, an appeal will have to be filed under the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. In that sense, it is submitted that the present application is not maintainable.

In that light, the learned counsel for the applicant seeks permission to withdraw this application with liberty to file an appropriate proceeding to challenge the order of the Sessions Court, rejecting the prayer for grant of anticipatory bail. 3.

The application is disposed of as withdrawn with liberty as aforesaid.
