IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO. 2777 OF 2024 Amol Sahebrao Ukhade (Ukharde) ...

Applicant

Versus

The State of Maharashtra ...

Respondent ****** Mr. Ramesh D. Patil a/w Ashish Gabhale and Iraa D. Patil i/by Jay & Co. for the Applicant.

Mr. Tanveer Khan, APP for Respondent-State.

****** CORAM: MANISH PITALE, J.

DATE : 15th OCTOBER 2024 P.C. :

.

One of the submissions made by the learned counsel for the applicant is that the Sessions Court, while granting anticipatory bail to one of the co-accused persons, observed that there was no medical certificate available to show the nature of injury suffered by the victim.

2.

In the present case, the statement leading to registration of the FIR, shows that specific allegation has been made against the applicant for having caused injury to the victim by means of a spade. The Sessions Court has also taken note of this fact while rejecting the application for anticipatory bail filed by the applicant.

3.

In this situation, it would be appropriate that the

bipin prithiani 901-aba-2777.24.doc investigation papers along with the injury certificate are produced for perusal of this Court.

4.

Hence, list on 17th October 2024, to be included in the supplementary list.

5.

The Investigating Officer shall be present, along with the investigation papers, on the next date of listing. MANISH PITALE, J.
