IN THE HIGH COURT OF JUDICATURE AT BOMBAY

State of Maharashtra ...
Respondent Mr. Shahid Ansari a/w. Mr. Akshay Bhalerao for Applicant. Mr. B. V. Holambe-Patil, APP for Respondent-State. Mr. Mohsin S. Pathan, API, Kondhwa Police Station, Pune. CORAM : MANISH PITALE, J.
DATE : OCTOBER 18, 2024 P.C. :
.
Heard Mr. Ansari, learned counsel for the applicant and Mr.Holambe-Patil, learned APP for the respondent-State. 2.
At the outset, the learned APP correctly points out that this application is not maintainable. This very applicant had filed Anticipatory Bail Application No.1736 of 2024. It was heard at length on 02.07.2024 and the following order was passed:- .
After arguing for some time and when this Court was inclined to dismiss the application, the learned counsel for the applicant, on instructions, seeks permission to withdraw the application.
2.
Hence, dismissed as withdrawn."
3.
It is obvious from the above-quoted order that the applicant argued the case on merits and when this Court was not in agreement with the contentions raised on behalf of the applicant, the application was withdrawn.

In such a situation, the present application being only an attempt 1/2
904_ABA2806_24.doc to re-argue the matter on merits cannot be permitted and hence it is dismissed as such.
