Heard the learned Counsel for the parties.

This is an application for pre-arrest bail in connection with C.R. No.0213 of 2024, registered with Sarkarwada Police Station, Nashi, for the offences punishable under Sections 409, 420, 468, 471, and 120-B read with 34 of the Indian Penal Code.

By an order dated 22 October 2024, this Court was persuaded to grant interim bail to the applicants. The learned Counsel for the applicants submits that, in compliance with the aforementioned order, the applicants have appeared before the Investigating Officer and cooperated with the investigation. 4.

It was previously noted in the interim order that the underlying dispute exists between Nashik Diocesan Trust Association Pvt. Ltd. and Nashik Diocesan Council. This dispute primarily appears to be of a civil nature, as observed by this Court. Consequently, the applicants have remained under interim protection granted by this Court since 22 October 2024.

Considering the aforementioned observations and reasons outlined, particularly the observations detailed in paragraphs No.6 and 7 of the interim order, it is appropriate and justified that the interim bail granted to the applicants be confirmed and made absolute. Accordingly, the following order is passed :

ORDER

(i) The order dated 22 October 2024 granting interim protection to the applicants is made absolute on the terms and conditions incorporated therein.

(ii) The applicants shall attend the concerned police station as and when required by the Investigating Officer till filing of the charge sheet.

(iii) It is clarified that the observations in this order are prima facie and confined to determining the applicants' entitlement to pre-arrest bail.
