Heard Mr. More, learned Counsel appearing for the Applicant in Anticipatory Bail Application No.2965 of 2024, Mr. Deshpande, learned Counsel appearing for the Applicant in Anticipatory Bail Application No.2896 of 2024 and Ms. Yadav, learned APP for the Respondent-State of Maharashtra.

By the present Anticipatory Bail Applications, the Applicants are seeking pre-arrest bail in connection with CR No.281 of 2024 registered with the Bhadrakali Police Station, Nashik City, for the offences punishable under Sections 406, 409, 420 read with 34 of the Indian Penal Code, 1860.

The prosecution case is set out in Paragraph No.2 of the Order dated 25th September 2024 passed by the learned Additional Sessions Judge, Nashik in Criminal Bail Application No.1868 of 2024, which reads as under :- "2.

It is stated in the information dated 31.08.2024, given by informant Pradeep Madhukar Wagh that in the month of April 2023, he came to know the advertisement of Rajasthan Multi State Co.Op.Society Ltd., Parali Vaijnath (hereinafter called as "Society"), that the society will give 12% to 13 % returns on investments. The informant also came to know that one branch of the society is opened at Nashik. Therefore, the informant had been to Nashik branch. Branch Manager Ashok Mundada and Bank Representative/advisor Santosh Mundada met him and promised that 1% p.m. returns will be given to him on Fixed Deposit amount. Therefore, the informant and his wife invested the amount in the society. Till January 2024, amount of interest is credited by the society in their account. But, thereafter, the society stopped to credit the interest on investment. That time, Ashok Mundada and Santosh Mundada told the informant that due to failure of computer system the amount of interest is not credited to their account. Then the informant had been to the head office of the society.

The informant was assured that the amount will be given to him after maturity period of fixed deposit. But, after maturity period also, the amount is not given to him. As such, he is cheated for an amount of Rs.46,60,000/-. The informant also came to know that the society also cheated other investors. On the basis of such information, a crime is registered against the applicant and others"

A learned Single Judge by Order dated 13th November 2024 passed in Anticipatory Bail Application No.2965 of 2024 and by Order dated 25th October 2024 passed in Anticipatory Bail Application No.2896 of 2024 has already granted protection to the Applicants.

In those Orders, it is stated that the role of the Applicants at the most, could be said to be that of consultants. 6.

Thus, in the facts and circumstances, Anticipatory Bail Application No.2965 of 2024 is disposed of in terms of the Order dated 13th November 2024 and Anticipatory Bail Application No.2896 of 2024 is disposed of in terms of the Order dated 25th October 2024.
