Ms. Sonia Santis i/by Umar Kazi for Respondent No.2. Mr. R. B. Madane, PSI, Kolshewadi Police Station is present. ----------------- CORAM : ADVAIT M. SETHNA, J.

DATE : 6 OCTOBER 2025 P.C.:- 1.

Heard learned counsel for the parties. These proceedings relate to CR No.0933 of 2024. The FIR has been registed by the Kolsewadi Police Station, Thane on 9 September 2024 at 15:25 hours. The alleged offences are under Sections 498-A, 323, 504, 506 and 34 of the Indian Penal Code, 1860 ("IPC") and under Section 4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019.

2.

The allegations in the FIR mainly center around Section 498-A of the IPC, where the informant (wife) had made allegations against the accused (husband). Both the Applicant and the Informant are present before the Court. It has now transpired, as submitted by the learned counsel 1/3

2 38-ABA-2984-2024.doc for the parties that the Applicant and informant (husband and wife) have decided to settle their disputes. The parties were accordingly referred to mediation by an order of this Court dated 14 February 2025. 3.

The mediation is successfully concluded and the parties have arrived at the consent terms in the mediation proceedings. The parties have placed such consent terms dated 30 September 2025 before the Court. There is no dispute with regard to the signatures appended to the consent terms. The advocates have duly identified the parties to the consent terms respectively. Such consent terms are taken on record of this Court and marked 'X' for identification.

4.

These consent terms mainly record that all complaints and pending proceedings filed by the parties against each other shall duly stand withdrawn. The parties have also in paragraph 11 of the said consent terms record that the informant wife shall give her consent affidavit for quashing the FIR against the Applicant and his family members before this Court. 5.

The learned advocates for the Applicant and the Informant submit that the parties would be moving this Court for quashing of CR I/933/2024 and case number RCC/290/2025 filed at the Kolsewadi Police Station and proceedings which are pending presently before the learned Metropolitan Magistrate Court at Kalyan. Ms. Kak, learned APP would submit that there is no bar/impediment in disposing this Anticipatory Bail Application, considering the above developments. 2/3

3 38-ABA-2984-2024.doc 6.

Accordingly, for the reasons recorded above, the Anticipatory Bail Application is Disposed of.
