Heard Mr. Bhosale, learned counsel for the applicant and Mr.Sonavane, learned APP for the respondent-State. 2.

The applicant is apprehending arrest in connection with FIR No.0300 of 2024 dated 07.10.2024 registered with Vishrambaug Police Station, District - Pune, for offence under Sections 308(2) read with Section 3(5) of the Bhartiya Nyaya Sanhita, 2023 (BNS). 3.

The offence, in the present case, pertains to extortion. The informant, who is a doctor, has alleged that the applicant threatened about getting a case registered against him in the context of a person having committed suicide in a rehabilitation centre run by the informant. The statement of the informant gives the details as to the manner in which the applicant was repeatedly contacting the informant, threatening him and extorting huge amounts of money, including an amount of Rs.3 lakhs. A supplementary statement of the informant was also recorded, which further gave details regarding the extorted amount. MINAL SANDIP PARAB by MINAL SANDIP PARAB Date: 2024.11.19 10:49:41 +0530 4.

Although the learned counsel for the applicant submits that this 1/2

511_ABA3012_24.doc was in the backdrop of proper inquiry and investigation, not being conducted into the suspicious death of the individual in the rehabilitation centre of the doctor - the informant, this Court finds that the statement of the informant leading to registration of the FIR, sufficiently makes out the ingredients of the offence under Section 308(2) of the BNS, which pertains to extortion.

The learned APP has also brought to the notice of this Court that the applicant has criminal antecedents, with serious offences registered against him for trafficking of human beings and also under the provisions of the Immoral Traffic (Prevention) Act, 1956. 6.

No case is made out for anticipatory bail. The application is dismissed.
