IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.3068 OF 2024 Hanmant Mahadev Katakdaunde ...
Applicant Vs.
State of Maharashtra ...
Respondent Mr. Sainath a/w. Mr. Yogesh Sukale i/b. Mr. Aadesh Kondedeshmukh for Applicant.
Mr. Bapu V. Holambe-Patil, APP for Respondent-State. CORAM : MANISH PITALE, J.
DATE : NOVEMBER 19, 2024 P.C. :
.
When this application is called out for hearing, the learned APP informs this Court that offenecs under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC & ST Act) have been added. The order dated 18.10.2024 passed by the Sessions Court, rejecting the anticipatory bail application of the applicant, does not show that such offences were added. It appears that the offences have been added after the order was passed by the Sessions Court. 2.
In any case, the learned APP submits that if offences under the SC & ST Act have been added, an appeal may have to be filed and that the present application cannot be entertained by this Court. 3.
It would be appropriate that the investigation papers are produced before this Court for clarity in the matter.
4.
Since the concerned police officers are busy in election duty, list this application for further consideration on 25.11.2024 in the production board.

In the meanwhile, the learned counsel for the applicant may also reflect on the question as to whether the applicant would pursue the present application or filing of an appeal would be appropriate. (MANISH PITALE, J.) Minal Parab 2/2
