Heard Mr. Punrwant, learned counsel appearing for the applicant, Mr. Khan and learned APP for State.

The applicant is apprehending arrest in connection with FIR No.0408 of 2024 dated 12.09.2024 registered at Vijapur Naka Police Station, District- Solapur, for offences under Sections 471, 468, 467, 465 and 420 of the Indian Penal Code,1860 (IPC).

The allegation against the applicant is that as the secretary of an education society, he forged a government resolution dated 28.02.2014 and used the same for the purpose of transferring a school being managed by the said education society.

Although, the allegation against the applicant is serious, but for an alleged act undertaken in February, 2014, the FIR has been lodged on 12.09.2024. It is brought to the notice of this Court that in the interregnum, several complaints were addressed to the education department in this regard and there were orders closing inquiries 1/2

903_Aba_3071_24.odt instituted in pursuance of such complaints, including closing of an inquiry by order dated 16.12.2019. It is also not clear as to why only the secretary of the said education society i.e. the applicant before this Court has been singled out as the person who committed the forgery. 5.

While keeping the application pending, interim order can be granted in favour of the applicant, subject to specific conditions. 6.

In view of the above, the following interim order is passed:- A.

Till the next date, in the event the applicants are arrested in connection with FIR No. 0408 of 2024 dated 12.09.2024 registered at Vijapur Naka Police Station, District- Solapur, he shall be released on bail on furnishing PR Bond of Rs.50,000/- and one or two sureties in the like amount; B.

The applicant shall remain present before the investigating officer on 25.11.2024 and 26.11.2024 between 10:00 a.m. and 12 noon and thereafter, as and when called by the investigating officer. He shall co-operate with the investigation;

C.

The applicant shall not influence the informant, witness or any person concerned with the case and he shall not tamper with the evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being recalled.
