In this application, at the outset the learned counsel for the applicant relied upon statements made in paragraph Nos.1 and 2 of the application, to contend that the anticipatory bail application filed before the Sessions Court, which was dismissed on 04th October, 2024, was the first such anticipatory bail application filed on behalf of the applicant. But, the learned APP correctly points out that in the application filed before the Sessions Court, it was stated that the said application was the second anticipatory bail application of the applicant, the first application having been rejected on 30 th May, 2019.

If the statement made before the Sessions Court in the anticipatory bail application is correct, the statements made in the present application before this Court on affidavit by the applicant can be said to be Shrikant Malani
912.ABA.3100.2024.doc false statements. On this ground alone the present application deserves to be dismissed.

In this backdrop, the learned counsel for the applicant seeks adjournment to take appropriate instructions in the matter. 4.
Hence, list on 27th November, 2024, to be included in the "Supplementary List."
