In this application, on 26.11.2024, this Court granted interim relief in favour of the applicant, subject to specific conditions. Notice was issued to respondent No.2, as offences under the Protection of Children from Sexual Offences Act, 2012, are also registered in the present case.

The learned APP has tendered a document, which shows that respondent No.2 was served on 04.12.2024. The said document is taken on record. In the said document, respondent No.2 has indicated that she desires to avail legal aid. 3.
In view of the above, the High Court Legal Services Committee is directed to appoint an advocate from its panel to represent respondent No.2. The applicant shall furnish a copy of the application on the office of the High Court Legal Services Committee within one week from today.

At this stage, the learned APP submits that the the applicant did appear before the investigating officer, in terms of direction issued by this Court in the interim order. But he has not fully co-operated. It is submitted that when the applicant was asked to give sample of his handwriting to co-operate with the investigation and also to submit certain documents, he refused to do so. This is a serious matter.

The learned counsel for the applicant submits that the applicant would abide by any further direction that may be issued by this Court and that he would co-operate with the investigation to the fullest. Only as a matter of last chance, the applicant is shown indulgence by this Court.

Accordingly, list the application for further consideration on 14.01.2025, High on Board.

All the conditions imposed in the interim order dated 26.11.2024 shall continue to operate as conditions on which the interim relief is continued. The applicant shall appear before the investigating officer on 16.12.2024 and co-operate with the investigation fully, including giving sample of his handwriting and any other document in his possession, that may be called for by the investigating officer.
