By this application, the applicant seeks pre-arrest bail in connection with CR No.877 of 2023, registered with Kandivali Police Station, Mumbai, for offences punishable under Sections 420, 465, 466, 468 and 471 read with 34 of the Indian Penal Code, and Section 66D of the Information Technology Act, 2000.

The prosecution alleges that the applicant forged a birth certificate allegedly issued by the Vasai Virar Municipal Corporation in order to enable the co-accused to obtain a passport.

I have heard Mr Kamar Ali Shaikh, the learned Counsel appearing on behalf of the applicant, and Mr Yogesh Dabke, the learned Additional Public Prosecutor representing the respondent/ State, and perused the record.

At the outset, the learned Additional Public Prosecutor representing the respondent/ State, based on instructions from the investigating officer, acknowledges that the applicant has cooperated with the investigation by duly attending the police station. The learned APP concedes that the investigation is complete, nothing remains to be recovered or discovered from the applicant, and a charge sheet has already been filed in April 2024. Furthermore, as per the instructions from the investigating officer, the learned APP states that the prosecution does not require the applicant's custody.

In light of the above, the application stands allowed in the following terms:
(i) In the event of the applicant's arrest in
connection with CR No.877 of 2023, registered with Kandivali Police Station, Mumbai, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.
(ii) The applicant shall regularly attend the trial Court and cooperate with it for the expeditious disposal of the case.
(iii) The applicant, through himself or any other person, shall refrain from indulging in any activity that may tamper with the evidence or influence witnesses.
