Heard Mr Sachin Kumar Rajepandhare appearing on behalf of the applicants and Mr Prashant Jadhav, the learned Additional Public Prosecutor representing respondent/State. 2.
This is an application for pre-arrest bail filed by the
applicants, apprehending arrest in CR No.0549 of 2024 dated 23.08.2024, registered at Mohol Police Station, Solapur, for the offences punishable under Sections 140(2), 119(2), 115(2), 351(2), 351(3), 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023, ('BNS').

It is alleged that the applicants who are step-mother and step-brother of the informant, under threat and coercion, forced the informant to go to the office of the Registrar at Pandharpur and to execute a relinquishment deed in their favour.

The learned Counsel for the applicant emphasises the delay in lodging the FIR and execution of the registered relinquishment deed. It is pointed out that the real brother of the informant is one of the beneficiaries under the registered relinquishment deed, thereby falsifying the allegations made against the applicants.

The learned APP, based on instructions from the investigating officer present in Court, acknowledges that the investigation is almost complete and the prosecution is intending to file the charge sheet shortly. The learned APP, fairly concedes that the applicant's custodial interrogation is not required. In light of these circumstances, the interim
protection granted by this Court on 06.12.2024 is made absolute on the same terms and conditions.
