In the present Anticipatory Bail Application filed under Section 438 of the Code of Criminal Procedure, 1973, the relief sought is of pre-arrest bail in connection with CR No.82 of 2016 registered with the Lashkar Police Station, Pune City, for the offences punishable under Sections 120B read with 406, 420, 468 and 471 of the Indian Penal Code, 1860.

A learned Single Judge by Order dated 4th December 2024 has already granted interim protection to the Applicant.

The age of the Applicant is 80 years. The FIR is concerning the loan obtained in the year 2013 and the FIR has been lodged in the year 2016.

As the Applicant is a senior citizen of 80 years, the Anticipatory Bail Application is allowed.

In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Vivek Alphonsus Aranha, in connection with CR No.82 of 2016 registered with the Lashkar Police Station, Pune City, he be released on bail on his furnishing PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
(b) The Applicant shall attend the concerned Police Station as and when necessary and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and
shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.
