When this application for anticipatory bail is called out, at the outset, Mr. Agarkar, learned APP has brought to the notice of this Court that proceedings were already undertaken under Section 82 of the Code of Criminal Procedure, 1973 and a standing non-bailable warrant was issued by the Jurisdictional Magistrate on 23.07.2024 against the applicant and that therefore, this application is not maintainable as per settled law.

In this situation, Mr. Mishra, learned counsel for the applicant, on instructions, sought permission to withdraw the present application. 3.
