By this application, the applicant seeks pre-arrest bail in connection with CR No.1160 of 2024, registered at Manpada Police Station, Mumbai, for offences punishable under Sections 109, 189(2), 189(3), 189(4), 351(3), 190, 191(2), 191(3), 324(4) of Bhartiya Nyaya Sanhita, 2023, along with 3, 4, 25,

27 of the Arms Act, 1959, read with 37(1), 135 of the Maharashtra Police Act, 1951.

According to the prosecution, on 21 October 2024, at around 8:00 p.m., the applicant, along with the co-accused, formed an unlawful assembly, brandished a revolver, and threatened to kill the informant.

Upon perusing the records, it appears that the sole allegation against the applicant is that he was in the company of Shivam Tripathi, who is accused of pointing a revolver at the informant. There are no claims that the applicant used any weapon, threatened the informant or caused any injury during the incident. The alleged weapon was reportedly recovered at the behest of the co-accused, and nothing is to be recovered from the applicant. Hence, the following order.

ORDER

(i) In the event of the applicant's arrest in connection with CR No.1160 of 2024, registered at Manpada Police Station, Mumbai, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.

(ii) The applicant shall attend the concerned police station as and when required.

(iii) The applicant, himself or through any other person, shall not indulge in any activity that may tamper with the evidence or influence witnesses.
