By this application, the applicant seek pre-arrest bail in connection with CR No.646 of 2024, registered at Goregaon Police Station, Mumbai, for the offences Page No. 1 of 3

Chitra Sonawane 6-aba-3362-24.doc punishable under Sections 318(4) read with 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023.

At the outset, the learned APP, submits that the investigation in the present case has been concluded, and the charge sheet has already been filed. He further submits that the recovery of gold ornaments has been duly effected from the co-accused, and there is no further recovery or discovery required from the applicant. The prosecution does not seek the custodial interrogation of the applicant and extend the consent for grant of anticipatory bail to the applicant.

In view of the aforementioned submissions, particularly the fact that the investigation stands concluded, the charge sheet has been filed, and the relevant recovery has already been made from the co-accused, this Court finds it appropriate to grant anticipatory bail to the applicant. Accordingly, the following order is passed :

ORDER

(i) In the event of the applicant's arrest in connection with CR No.646 of 2024, registered at Goregaon Police Page No. 2 of 3

Chitra Sonawane 6-aba-3362-24.doc Station, Mumbai, he shall be released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.

(ii) The applicant shall regularly attend the trial proceedings and cooperate for the expeditious disposal of the case.

(iii) The applicant, himself or through any other person, shall not tamper with the evidence or influence the witnesses.
