This is an application for Anticipatory Bail. 2.

The applicants are apprehending their arrest in Crime No. 634 of 2024 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(2), 189(2), 190, 191(2), 352 & 351(2) of the Bharatiya Nyaya Sanhita, 2023. 3.

It is the case of the prosecution that on the date of incident, which took place on 11.11.2024, the present applicants and other co-accused assaulted the first informant with a stick as well as fist and kick blows on account of political rivalry. 1/3

I have heard the learned counsel for the applicants and the learned counsel for the respondent-State. 5.

The learned counsel for the applicants submits that the applicants have nothing to do with the alleged crime. It is submitted that custodial interrogation is not necessary as nothing is to be recovered at the instance of the applicants. It is submitted that there are no other criminal antecedents against the applicants.

On the other hand, the learned APP for the respondentState submits that the applicants assaulted the first informant by stick. It is submitted that during the course of investigation, CCTV footage came to collected. It is submitted that in the CCTV footage the applicants can be seen assaulting the first informant. 7.

It appears that the first informant has not sustained any injury in the incident. The stick which was lying at the place of incident has already been seized. Nothing is to be recovered at the instance of the present applicants. There are no other criminal antecedents. Considering the said facts and circumstances, I am 2/3

inclined to release the applicants on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicants in connection with Crime No. 634 of 2024 registered at Nirmal Nagar Police Station, for the offences punishable under Sections 118(2), 189(2), 190, 191(2), 352 & 351(2) of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- each with one or two sureties in the like amount.

c) The applicants shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.
