By this application, the applicant seeks pre-arrest bail in connection with CR No.715 of 2023, registered at Mahatma Phule Chowk Police Station, Thane, for offences punishable under Sections 420, 406 and 354 of the Indian Penal Code.

The prosecution alleges that between June 2020 and March 2021, the informant entrusted the applicant with Rs.18,56,540/- for investment on the promise of lucrative returns. However, in March 2023, when the informant confronted the applicant about the funds, he not only refused to return the money but also verbally abused her and physically assaulted her by twisting her arm. 3.
Mr Vijay Dighe, the learned Counsel appearing on behalf of the applicant, contends that following the rejection of the applicant's anticipatory bail application by this Court on 6 March 2024, the applicant and the informant reached a mutual understanding to resolve their dispute amicably. On 6 April 2024, they formalised this agreement through a Memorandum of Understanding, wherein the applicant committed to pay the informant Rs.12 lakhs, of which a substantial amount of Rs.9 lakhs has already been disbursed. The informant has received this sum, a fact also known to the investigating officer. The learned Counsel further submits that the investigation has reached its conclusion, and a charge sheet has been filed. There is nothing to be recovered or discovered from the applicant. At the outset, Mr Yogesh Dabke, the learned Additional Public Prosecutor representing the respondent/ State, based on instructions from the investigating officer present in the Court, submits that the investigation has concluded and a charge sheet has been duly filed. Furthermore, the prosecution does not require the applicant's custody.

As the investigation has now reached its conclusion and a charge sheet has been duly filed, there remains nothing further to be recovered or discovered from the applicant. In light of the unequivocal no objection expressed by the learned APP, this Court is inclined to exercise its discretion in favour of the applicant. Hence, the following order:
ORDER
(i) In the event of the applicant's arrest in connection with CR No.715 of 2023, registered at Mahatma Phule Chowk Police Station, Thane, he shall be Page No. 3 of 4
Chitra Sonawane 903-aba-3537-2024.doc released on bail upon executing a PR Bond of Rs.25,000/- and furnishing one or more sureties in the like amount.
(ii) The applicant, himself or through any other person, shall not tamper with the evidence or influence witnesses.
