Heard Mr. Naik, learned Counsel appearing for the Applicant, Ms. Yadav, learned APP appearing for the Respondent No.1-State and Mr. Kakade, learned Counsel appearing for the Respondent No.2.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.984 of 2024 registered with Shikrapur Police Station, Pune Rural, Pune, for the offences punishable under

Sections 189(1), 189(2), 191(2), 190, 115(2), 118(1), 125(b) and 119 of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is set out in paragraph No.2 of the order dated 12th December 2024 passed by the learned Additional Sessions Judge, Pune, in Criminal Bail Application No.7063 of 2024, which reads as under:

"2. The prosecution has come with the case that, the incident took place on 01.11.2024. Because of a civil dispute, the applicants were asserting that they are the owners of the property in which the informant mounted his electric meter on a tree. All the accused including the present applicant formed an unlawful assembly. In prosecution of the common object of the assembly, they inflicted the injuries to the informant and his family members by kicks and fists blows. The wife of the informant was tried to be disrobed. When a daughter of the informant was making a video of the incident, the main accused i.e. the applicant snatched that mobile handset. Then the applicant chased the informant and his family members by his own fourwheelers vehicle. He gave dash by the said vehicle to the informant.

The informant fell down on the bonnet of the vehicle and in the same condition he was dragged for 300 to 400 meters which resulted serious injuries to the informant. As such, the prosecution has come with the case that the applicant along with other accused committed the above offences also being the members of the unlawful assembly."

Ms. Yadav, learned APP submits that the offence is very serious. Therefore, she submits that the Anticipatory Bail Application be rejected.

Mr. Kakade, learned Counsel appearing for the Respondent No.2 submits that the Applicant has threatened the First Informant after the protection has been granted to the Applicant. 6.

Perusal of the record shows that a learned Single Judge has protected the Applicant by order dated 2nd January 2025. The said order is in operation for last about more than one year. The Applicant is Primary School Teacher. Perusal of the record further shows that the incident has taken place suddenly. In any case, the chargesheet has already been filed and thus the investigation is completed.

Accordingly, the case is made out for grant of Anticipatory Bail by imposing stringent conditions. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Vinayak

Sadashiv Thite in connection with C.R. No.984 of 2024 registered with the Shikrapur Police Station, Pune Rural, Pune, the Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(b) The Applicant shall attend the Shikrapur Police Station, Pune Rural, Pune, on every Sunday between 11:00 a.m. to 02:00 p.m.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the learned Trial Court/concerned Sessions Court.
