This is an application for anticipatory bail. 2.

The applicants are apprehending their arrest in Crime No.82 of 2023 registered at Arnala Police Station, Mira-Bhayander, Vasai Virar for the offences punishable under Sections 420 read with 34 of the Indian Penal Code (IPC).

According to the prosecution, the present applicants and other co-accused had induced the complainant to purchase certain immovable property. It is alleged that they accepted Rs.10 lakhs from him towards consideration and when he had asked them to execute the sale deed they avoided to do so. 4.

I have heard the learned counsel appearing for the applicants and the learned APP for the respondent / State. Dinesh S. Sherla 1/2

The prosecution has already filed the charge-sheet. Prima facie, the dispute appears to be of civil nature. In that view of the matter, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed.

ORDER

A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicants in C.R. No. 82 of 2023 registered at Arnala Police Station, Mira-Bhayandar, Vasai Virar for the offences punishable under Sections 420 read with 34 of the Indian Penal Code (IPC), they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount each. C) The applicants shall attend the concerned police station once in a month, i.e., on 1st Saturday between 11.00 am to 2.00 pm, till conclusion of the trial.
