Heard Mr. Mandal, learned Advocate for Applicant and Mr. Sonavane, learned APP for Respondent - State. 2.

This is an Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Anticipatory Bail in connection with FIR No.307 of 2024 registered with Marine Drive Police Station for the offences punishable under Sections 115(2), 118(1), 118(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

By order dated 07.01.2025, I have already granted Anticipatory bail to other Accused namely Dilip Dhanu Sahu in Anticipatory Bail Application No.15 of 2025.

Role of the Applicant - Manishkumar Rajkumar Sahu before me is identical to the role of the Accused therein. What happened in the altercation opposite INOX Theatre near Nariman Point, Mumbai is clear and evident in the fact that in so far as the Applicant is concerned, he attempted to quell the scuffle between two warring groups on account of uploading of a dance video of one of the friends of the Complainant. The said friend of the Complainant works at the food counter of INOX Theatre where the Complainant as also the Accused would regularly go and they were all friends. 5.

Needless to state that it has been recorded in the order dated 07.01.2025 that the Complainant has filed her NOC also as to what transpired outside the INOX Theatre on the date of incident. Applicant is a student in college.

An arguable case has been made out by Mr. Mandal for grant of Anticipatory bail. Therefore, present Anticipatory Bail Application stands allowed in terms of prayer clause 'a'. Hence, the following order:-

O R D E R

(i) In the event of the arrest, Applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.5,000/- with one or two sureties in the like amount;

(ii) Applicant shall report to the Investigating Officer of the concerned Police Station, as and when called for by the Investigating Officer for investigation;

(iii) Applicant shall furnish particulars of his address and mobile number to the Investigating Officer within two days from today;

(iv) Applicant shall not misuse his liberty in any manner or influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence;

(v) It is directed that Applicant shall extend complete cooperation in the investigation of the instant case; and (vi) Any infraction of the conditions shall entail revocation of this order.

Parties to act on a server copy of this order. 8.

Anticipatory Bail Application is allowed and disposed in the above terms.
