Heard Mr. Desai, learned Advocate for Applicant; Mr. Karmakar, learned APP for Respondent - State of Maharashtra and Mr. Bhosale, learned Advocate persuading this Court to appear for the Complainant.

Applicant before me is arraigned as Accused No.6. She is wife of Accused No.3 called Aman Chohan. Accusation is that Accused No.3 - Aman Chohan received stolen jwellery from Accused No.1 who is daughter of Complainant. Though there is dichotomy as expressed by both sides with respect to the value of the amount of jewellery involved in the crime, that does not concern me at present for deciding this Application.

Both Mr. Karmakar and Mr. Bhosle in cohesion would submit
903.ABA.3575.2024.doc that present Applicant (wife) is part of a conspiracy hatched by Accused No.1 (husband) and she has been seen and found to have received / transported the stolen jewellery which is evident from the CCTV footage collected by the Investigating Officer. In paragraph No.10 of the order rejecting the Anticipatory Bail of the Applicant by the Trial Court it has been so stated. On the submissions made today when I called upon Mr. Karmakar to show the details of identification of Applicant he would show the photographs to me across the bar from which I am unable to make out.

Hence, I direct the concerned Investigating Officer to prepare a report and annex the said photographs etc. or CCTV footage slides identifying the Applicant therein to enable me to decide the present Application. It is clarified that identification of Applicant should be precise in the photographs to enable this Court to consider the case of the prosecution.

It is clarified that only until the next date no coercive steps shall be taken against the Applicant. This order is specifically passed in the view of the fact that Mr. Karmakar has informed me that Applicant has been absconding for the past several days and she is not available at the address given by her in the Application. 6.
Stand over to 10th January, 2025.
