DATE : 19th MARCH, 2025 P.C. :- By an order dated 7th January, 2025 interim protection was granted to the applicant. For ease of reference, the said order is reproduced hereinbelow :-

1. Heard Mr. Shaikh, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent - State of Maharashtra.

2. Mr. Shaikh in his usual fairness draws my attention to the order dated 18.12.2024 whereby the Application made by Applicant seeking extension of time to deposit the amount was rejected.

Mr. Shaikh would submit that in paragraph No.7 at page No.10 of the Anticipatory Bail Application, the Applicant has shown his bonafides by offering to bring the amount back by producing a fresh schedule for payment. As per that schedule Rs.1,10,000/- is stated to be ready and another Rs.75,000/- shall be paid on 10.01.2025. He would inform the Court that both these amounts are to be deposited with the Investigating Officer as directed. He would submit that tomorrow i.e.

2/4 08.01.2025, he will deposit the Demand draft of Rs.1,10,000/- and on Friday i.e. 10.01.2025, he will deposit Demand Draft of the amount of Rs.75,000/- with Investigating Officer.

4. In that view, the matter is adjourned to next week for compliance. If there is no compliance, this Application will stand automatically dismissed without recourse to the Court and prosecution will immediately take appropriate steps.

5. Ms. Bajoria, though appears for Respondent - State of Maharashtra has not been served with copy of Application. Applicant shall serve copy of Anticipatory Bail Application on the learned APP.

6. In the meanwhile, no coercive steps shall be taken against Applicant.

7. Stand over to 14th January, 2025. To be placed under the caption 'For Directions'.

By further order dated 5th March, 2025, the statement of the learned counsel for the applicant was recorded that the demand draft worth Rs.3,40,000/- would be handed over to the concerned police station.

The learned A.P.P. submits that the demand draft worth Rs.3,40,000/- has been handed over to the first informant. He submits that the custody of the present applicant is not at all necessary.

In view of the same, this anticipatory bail application stands allowed. Hence, the following order :-

ORDER

(a) The anticipatory bail application is allowed. (b) In the event of arrest in connection with FIR No. 0154 dated 5th April, 2024 registered with Tilak Nagar Police Station, Brihanmumbai Shahar for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code, 1860, the applicant shall be released on bail, on furnishing P.R. bonds to the extent of Rs.30,000/- with two or more sureties of the like amount. (c) The applicant shall co-operate with the investigation and attend the Investigating Officer of the concerned Police Station, as and when called. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

(e) The applicant shall furnish details of his residential addresses, contact numbers and e-mail addresses to the
