This is an application for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No.523 of 2024 registered at Jail Road Police Station, Solapur for the offences punishable under Sections 318, (4), 316(5), 316(2), 3(5) of the Bharatiya Nyaya Sanhitha Act 2023.

The applicant was working as Senior Clerk-Cum-Cashier in the said Government Polytechnic College, Solapur. The allegations against the Principal of the said College, who is co-accused in the present crime that he in connivance with the present applicant and other co-accused had disbursed the amount of Rs.87,27,890/- though his financial powers to disburse the said amount were withdrawn.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 5.

The learned counsel for the applicant submits that he followed the directions of the Principal and provided the cheque book.

I have perused the FIR. The main allegations are against the co-accused Ashok Upadhyay, who was the Principal at the relevant time. In that view of the matter, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Anticipatory Bail Application is allowed. B) In the event of arrest of the applicant in C.R. No.523 of 2024 registered at Jail Road Police Station, Solapur for the offences punishable under Sections 318, (4), 316(5), 316(2), 3(5) of the Bharatiya Nyaya Sanhitha Act 2023, he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.
